§1 General provisions

These Terms set out the rules for using the electronically supplied service in the form of the Płomyczek 3.0 web application (hereinafter: “Application”, “Service”), within the meaning of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means (consolidated text, as in force on the date of publication of these Terms).

The service provider for end users is the entity implementing and maintaining portal (hereinafter: “Administrator”). Their contact details are given above.

Accepting the Terms does not constitute consent to all data processing purposes. If consent is required for a specific purpose, the Administrator obtains it separately. We describe the processing rules, including the use of external AI services, in Privacy Policy.

§2 Definitions

  • User — a natural person who has an account in the Application or uses publicly available parts of the website, if any are made available.
  • Account — the set of permissions and data assigned to the User after registration or after the account is created by the Administrator.
  • Assistant — a program using artificial intelligence that enables text or voice conversations for educational purposes, based on a knowledge base prepared by authorised administrators or editors.
  • Games and tasks — educational exercises for learning and revising safety rules.
  • Classroom — group lesson plans with Janek's stories, tasks and tips for the facilitator.
  • Janek’s Missions — tasks with pictures and text that can be done without sound, speaking or a time limit.

§3 Subject and nature of the Service

The app is used for fire safety education and prevention, including conversations with the Assistant, preparing for threats as part of civil protection, and using games, missions and lesson plans. The Service is supplementary and educational.

Janek helps children learn safety rules, and Citizen supports people aged 16 and over with civil protection and emergency preparedness. The assistant is not a person or an emergency services dispatcher. Access to other assistants and educational features depends on the account’s role and permissions. Games, Classroom and Missions are available after logging in.

The assistant does not replace calling the emergency services, consultation with a qualified specialist, or legal acts and administrative decisions. In the event of a fire, a threat to life or health, or any other emergency, notify the services immediately — in Poland, first by calling 112.

The Assistant's answers may be generated automatically and may contain inaccuracies or errors. Before making any decision of significant importance to safety or rights, verify the information in the original materials and with official or expert sources. References may not be displayed alongside answers; this does not mean the answer has been verified by a specialist.

The Application interface may display the label test (beta) version, which means that the features, appearance or stability of the Service may change; the Administrator may introduce updates without prior notice of every minor technical change.

§3a Conversations, suggestions and voice

Conversations can be held in text or, if the account and browser allow it, via the “Talk to the assistant” option. Speech recognition requires the User to turn on the microphone themselves. After each answer, the User starts the next listening turn; the assistant’s reply can be interrupted, or the User can return to the conversation transcript.

Children's accounts have text chat and the app's read-aloud voice. The microphone is disabled for them. Speech recognition and browser voices may use external services, described in the Privacy Policy. Lack of microphone support does not prevent using text chat.

Suggested questions may be prepared by the editorial team or generated from the knowledge base. They help start a conversation; they are not ready-made advice or confirmation that a future answer will be correct. You can skip them and write your own question. Waiting time depends on service load; after an error, the retry button lets you return to the question in the same conversation.

§3b Games, activities with children and available missions

The games help you practice recognizing hazards, preparing for evacuation and asking for help. A game score, stars or task completion are not a school grade, a certificate or confirmation of rescue skills. Selected progress stays in the browser and may disappear after clearing site data; it does not create a public player ranking.

“Classroom” and “Janek’s Missions” are available after signing in. facilitators can use them in group sessions without separate accounts for children. They do not keep a pupil register, grades or rankings. Janek’s tips in Classroom are pre-prepared educational content. AI chat is a separate feature that facilitators can use to prepare sessions, after checking the answers.

The Classroom program is a pilot for expert consultation and trials with children. Using KG PSP materials as sources does not mean that KG PSP, CNBOP-PIB or any other institution has approved the program itself. The facilitator agrees with the teacher on the evacuation plan, how the alarm is raised, any help needed and the rules for calm exercises. Fire, smoke and real emergency calls must not be used as part of the portal's exercises.

A child can answer by pointing, in text, with a gesture or in another agreed way, or can watch or take a break. The portal does not replace individual support and does not include its own Polish Sign Language (PJM) translation; links to PJM materials lead to external PSP websites. Adults adapt the activities to the group's needs without entering children's data, diagnoses or descriptions of traumatic events into the app. Answers and the activity stage in Classroom and Missions are not saved and disappear when the page is refreshed or closed.

§4 Technical requirements

To use the Application, you need: a device with Internet access and an up-to-date web browser with JavaScript enabled and support for encrypted connections (HTTPS). The portal is provided over HTTPS. Some features (e.g. speech synthesis, speech recognition) depend on the capabilities of the User’s browser and operating system. Browsers apply their own audio playback rules (e.g. when the microphone is in use at the same time) — if there is no sound when a response is read aloud, follow the messages in the interface or replay the last response after listening has ended.

§5 Registration, account and security

When creating an account, the User provides truthful data to the extent required by the form, and voluntarily for optional fields. The User is responsible for keeping the password and — if enabled — the second authentication factor (2FA) confidential. Sharing the password and login codes with other people is prohibited. Sign-in and account settings remain in the facilitator's hands; children may do the exercises on the facilitator's device under supervision, without access to settings or login details.

Registration is available when the Administrator enables it. A new account awaits the Administrator’s activation; submitting the form alone does not grant access to the dashboard. A person aged 16 or over may create an account on their own. A child’s account is created by a verified adult guardian or an authorised administrator after confirming their authority and the guardian’s consent. The child uses the portal with an adult’s support.

Using the public pages does not require an account. Access to account features begins once the Terms are accepted and the account is activated. Users can stop using their account by deleting it in “My account” after confirming their identity. Deleting a guardian account also deletes the linked children's accounts and requires separate confirmation of this scope. Before deletion, you can download your data from the server.

Deleting an account does not clear game saves and preferences on devices where the platform was used. This data stays in the browser, is not included in the server export and can be removed by clearing site data. On a shared device, you should also log out when finished.

§6 Prohibited conduct

In particular, the following are prohibited:

  • using the Application in a manner contrary to the law or good practice, or that infringes the rights of third parties;
  • taking actions that could disrupt the Application or compromise its security (including attempts to bypass authentication or scanning for vulnerabilities without the Administrator’s consent);
  • uploading malicious content (e.g. malware) or files intended to cause harm;
  • manipulating the Assistant to obtain content inconsistent with the educational purpose of the Service, if this violates applicable law or these Terms.

The Administrator may block or delete an account if a serious breach of the Terms is found, in compliance with generally applicable law, including personal data protection law.

§7 Personal data protection

The rules for processing personal data, including data categories, purposes, retention periods and the rights of data subjects, are set out in Privacy policy and — with regard to data stored in the browser — Cookie Policy.

§7a Conversation history and administrative access

In the “Let's talk” tab, you can delete a single conversation or your entire history. A confirmed deletion cannot be undone in the panel. Deleting a conversation does not delete your account, permissions or other conversations.

An authorised administrator may read or delete a specific conversation to the extent necessary to handle a request, protect the platform or for another documented purpose. Access requires an additional login factor, and reading and deletion are recorded in the security log. The log is not used to assess children.

Deletion covers the conversation content in the active database. The record of the operation and backups are subject to the rules and retention periods described in the Privacy Policy. Deleting history does not replace the option to submit a personal data request.

§8 Intellectual property rights

Elements of the Application (layout, code, trademarks made available by rights holders) are protected under the laws on copyright and related rights and on industrial property, where those laws so provide. Subject-matter materials uploaded to the system remain with their owners or licensors. The scope of use of a material follows from its license or the law; a link to or access to a publication alone does not grant the right to freely copy and distribute it. We list the sources used with the lesson plans. The portal's illustrations are for illustration only and do not constitute instructions for rescue operations or technical documentation.

§9 Liability

The Administrator exercises the diligence appropriate to professional system maintenance but does not guarantee uninterrupted operation of the Application or entirely error-free operation of the Assistant.

The portal is for learning and preparing for hazards. In a real emergency, follow the instructions of the emergency services, the emergency number operator and the people leading the evacuation. AI answers and exercise results do not replace these instructions.

The provisions of this section do not exclude or limit liability towards consumers to the extent that such exclusion or limitation is not permitted under the Act of 23 April 1964 — the Polish Civil Code, or other mandatory provisions of law.

§10 Complaints regarding the operation of the Service

Complaints and bug reports can be sent to the Administrator’s contact given above. The report should describe the problem, give the approximate time it occurred, the page address and a contact for the reply. Do not send passwords, login codes or data about children or third parties.

The Administrator reviews the report and, if necessary, requests the information needed to process it. The response is sent through the same channel or to the contact address provided, without undue delay. If the Polish Consumer Rights Act applies to the complaint, a response is given within 14 days of its receipt, unless a separate provision states otherwise. Submitting a report does not limit the User’s statutory rights, including the right to lodge a complaint with the President of UODO (the Polish data protection authority).

§11 Changes to the Terms

The Administrator may change the Terms for important reasons (e.g. changes to the Application’s features, legal requirements, security protection). The Administrator gives notice of significant changes electronically or via a message in the Application, stating the scope of the changes and their effective date, with advance notice appropriate to the circumstances and in compliance with legally required time limits. Before that date, the User may stop using their account under the rules described in §5. Continued use of the Service after the changes take effect may require re-acceptance of the Terms if the law or the nature of the change so requires.

§12 Governing law and disputes

These Terms are governed by Polish law. Disputes will be resolved by the competent courts in accordance with generally applicable law, including provisions on territorial and subject-matter jurisdiction for consumer contracts.

§13 Final provisions

In matters not governed by these Terms, the provisions of the Polish Act on Providing Services by Electronic Means, the Polish Civil Code and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) apply, insofar as they concern the processing of personal data.

The User has access to the current Terms of Service in the Application. The organisation's internal documents that have not been made available to the User do not replace these terms of use of the Service.
